My argument is to the effect that whoever voted for banks to be able to charge high overdraft fees, especially on the basis of "fairness" to the banks, is ignoring the fact that overdrafting is a problem which banks could (and should, if they are obligated to best serving their customers) simply prevent altogether with existing infrastructure, removing the overdraft process entirely and instead simply returning NSF before allowing the account to go under $0.
All it would require is, upon a client making a payment, an internal check at the bank to see if the amount they're requesting is actually in their account or not. If it isn't, the bank returns NSF for the transaction instead of allowing them to overdraft, just to fail their transaction and hit them with an exorbitant $45 fee anyway. (this actually happens in canada, if it doesn't happen in the states)
If I were starting out again and wanted a credit product, I'd get a credit card. I definitely wouldn't get a bank account that acts like neither a safe place for my funds because it punishes me for not monitoring its balance on a daily basis, and isn't even a credit product because it doesn't allow me to complete the transaction which put me into overdraft.
I've never understood why banks don't just check to see whether the transaction would fail without charging you a monthly fee for "overdraft protection". It was one of the first reasons I'd ever been pissed off at a bank for personal reasons, and the answer seemed really obvious—which made it feel even more insulting that it happened. Makes you feel like we're run by people who are, at best, out-of-touch and very entrenched in traditional ways—and at worst, greedy pigs who actually think they get off on charging a poor person money which they, uniquely, have awareness over this poor person not having. It may sound cynical, but it makes you want to NEET your whole life so that you don't have to participate in such a bad game.

It's worse than that. Banks charge flat X amount for each overdrafted transaction. Because of this, the banks will process transactions not in the order of transaction, but will rank by transaction size first in order to maximize the number of overdraft fees.
