This fucking dickhead. This guy applied to our rental and stated on his application that he has no pets. Then right when I send him the lease to sign, he says he actually has two emotional support animals and that we can’t deny them. And he’s right. He already has my emails saying his application was approved, so if we pull back the lease, he can forward those emails to a lawyer and we’d easily get fined $16,000 plus fees for the lawyer. Fucking dick.
How to deal with s***** tenants as a Chad landlord
Rekt cunt.
The dogs shit on your carpet for free.
You got fucking out landlorded by your own tenant. Take the L and pray you don't have carpets.
Just jew him out of his security deposit at the end. That's what shitty rental companies do to me even though I fix shit that was broken when I got there and leave the place nicer than I found it.
have you tried not being a giant flaming faggot tho op?
I hope your carpet is brown.
Can you use the fact he lied about no pet?
Also can you just fucking stall?
I need to verify the discrepancy there...
And so it for months until he stops responding.
Btw he has no incentive to email shit it gives him no benefit he won't do it
Note he said ‘emotional support animals’ and not ‘service animals’. See what local laws say about the differences between the two and you might have some more leeway.
They are legally treated differently but you may still be fucked. But maybe not.
akc.org
I hate those bastards who try to claim this to bring their pets everywhere and act like entitled dicks.
In 2021 when property prices exploded, in my city, they made it illegal for landlords to not allow pets, they did this because so many got priced out of buying a home that a bunch of people were now faced with being renters for life so they felt bad for the rentoids and made it illegal for a landlord to ask if you have pets lol
Also I think he may need paperwork that it is an ESA.
Although all dogs offer an emotional connection with their owner, to legally be considered an emotional support dog, also called an emotional support animal (ESA), the pet needs to be prescribed by a licensed mental health professional to a person with a disabling mental illness. A therapist, psychologist, or psychiatrist must determine that the presence of the animal is needed for the mental health of the patient. For example, owning a pet might ease a person’s anxiety or give them a focus in life
Good Luck, OP.
Its really your fault for trying to put pet rent onto your rental unit. How tf are you going to charge 30 bucks a month for each pet on top of a 500 dollar deposit? You deserve it faggot
Most states allow telehealth as an acceptable way to get a diagnosis for anxiety. If your state requires that the practitioner has to be certified and living in the state then OP might have a case.
This is what you get for charging me 800 dollars over the life of my lease even though my pet is 15 years old hasnt pissed once inside or chewed up anything
I meant the pets being registered as ESAs. The fact that there are two seems suspect.
The difference between a legitimate ESA and a pet is the letter from your licensed mental health professional.
No letter, it’s a pet.
i just did this to my apartment complex, they wanted $500 per pet plus $25/month extra rent. I paid a therapist $180 dollars for a letter and i waived all those bullshit fees. Hope you mandated renters insurance in your lease that includes pet damage. I think you may be able to fight it if this is your only rental property
Why do you have brock lessenor as your tenant OP?
He can show a letter but it has to be recognized valid from the state but youre right in that regard
Not OP, but I don't give a shit about pet rent. If someone was willing to pay an extra 300 dollars a month for their pets to move in, I'd still pass it over. I'd rather avoid all of the damages pets bring.
That being said, you fucking entitled pet owners either need to cough up pet rent, or be willing to put up a huge downpayment. You think just because your dog isn't chewing up the walls that it's a blessing and no one can complain. Their nails scratch the floors and furniture, they shed, they shit all over the yard, that shit then gets thrown into the trash and it never smells the same again, they have hair and dander clog up air filters, and even the most well potty trained dog will still get an upset stomach and throw up/projectile diarrhea everywhere.
I've lived with roommates all of my life and I will never let someone bring pets into my home again. Even the best behaved dog in the world was still a burden. I'll fight it with lawyers, I'll act hostile to the roommate, I'll raise the rent as much as legally allowed "this has nothing to do with the pet, I just need more rental income."
Fuck you entitled pet owner fucks. You shouldn't have multiple fucking dogs if you can't afford a place for them to live, or if you aren't willing to at least pay an extra 30 a month which isn't going to get pocketed by a greedy slumlord, it's probably going to inevitably put towards wear and tear.
most pet protection laws have some restrictions. Like "ADA requirements" only apply if it's a multifamily unit, or they don't apply if the landlord lives there on site, or they don't apply if the landlord has 2 or less properties.
I bought a huge house and have 3 roommates living here, so even the emotional support scammers can't play me. You also can legally request a doctor's note stating that the pet is necessary. Unfortunately any doctor will sign anything if you whine at them enough, or just keep jumping doctor to doctor, but at least you can inconvenience them for screwing you over.
You can't legally ask them to prove that it's a real emotional support animal or what they need it for. Fucking pussies.
Can you use the fact he lied about no pet?
No. If it is a true "disability pet" they don't have to disclose it at all. It's not even legally defined as a pet, it's more closely defined as a tool, so you can't charge a pet fee. you can pursue them for damages, and if the animal somehow misbehaves you could contest it as destructive.
That being said, if I was OP, I would get an extremely detailed inspection report. Get prove of the quality of the floors, with high quality pictures. When that fucker moves out, sue them for every penny you can. Scratched up floors? Blame the dog. Dog scent? Charge them for a full shampoo of every carpet in the house. Dead spots in the grass? Pay a landscaper to fix it and claim dog piss killed those spots. No fucking mercy.
You know i have two full gallons of molded bacteria riddled rendered beef fat i also use to retaliate. Do you wanna stomach 20k in pipe repairs when you cant prove the culprit faggot?
Your stupid fucking dog will absolutely cause wear and tear to a unit. Wear and tear is the key word. Wear and tear is inevitable, but the more bodies living there, the more wear and tear you get. So you're damn right I want some compensation for dog nails scratching up the floor, or dog piss killing the grass. If you can't afford an extra 30 a month, don't get a fucking job. You should have your own place, or you should come to terms that having a harder time to find a place to rent is going to be more difficult with a pet.
What if there are other roommates in the dwelling? Someone is allergic to dog dander, and they can't move in, or the place is fucking tarnished once you move out for anyone else sensitive to dogs. Then other roommates say "HOW COME HE CAN GET A DOG BUT I CAN'T!?!" then everyone moving in wants their own emotional support dog. Fuck you pieces of shit.
*don't get a fucking dog.
How do you get a lawyer for something like this? My landlord broke the lease and straight up moved into the house I was leasing and threw away $10k+ of my property in the process.
It's easy to get a lawyer. Just google lawyers that specialize in tenant/landlord disputes. If the landlord really had no grounds to break the lease, but blatantly broke it like that, tons of lawyers will be drooling to take your case.
Keep in mind that you should REALLY read the lease thoroughly before wasting your time and money. A lot of leases specify that you may need to go to arbitration first, or that you are footed with the legal bills. If the landlord is the guilty party that broke the lease, then those parts of the lease may not apply. Did the lease specify you were renting the whole house, or just a room? If it's just a room, other people can move in.
Either way, throwing away your property is basically a clear cut victory in your favor unless you are leaving out details. the lease may specify that you aren't allowed to keep certain things on the property, but even then they need to give you reasonable time to move it.
We had a pretty informal lease as it was with a family member, just a handwritten thing and they had the only copy.
But it was clear from communication history that it was a year lease, exclusive rights to the property. Because I didn’t have a copy of the lease the police wouldn’t do anything. I tried reaching out to lawyers but didn’t really get anything back and was flat broke at the time. Do I have a chance?
Not sure. If I could prove that you fucked up the pipes then you're fucked. I don't know shit about pipes though, so maybe I'm fucked. Either way you've just proven that I will never rent to a pet owner and will fight tooth and nail to keep you entitled fucks out. Like I said earlier, if you can't afford an extra fuckign 30 bucks a month, and can't afford your own house, don't get a fucking dog. They are fucking burdens to everyone else.
I’m also in Oregon where verbal leases are supposed to be valid but obviously that didn’t help me at all.
And I don’t know how I’d prove that they destroyed my property.
Damn, that sucks. You may be fucked then. You can go onward with suing, but it may be a waste of time, assuming they most likely will deny it and it's word against word.
Definitely don't ever do anything as important as housing informally again though. When it comes to ownership of something that valuable, EVERYTHING should be legally required in writing, in every state. That's why squatters get away with the shit they do. You can legally pursue the lost property, but it may be a waste of money, it depends on how upset you are.
The best I have for proof is an email with a formal lease attached saying ‘fill it out and I’ll sign’. Might that fly?
And yeah it ruined my life. It was $10k+ of business equipment I purchased using student loans. I had to drop of college as a senior math/cs majors to cover my bills afterward and ended up going out of business, probably declaring bankruptcy soon. She had moved in at the worst time, I had just lost my job and had no emergency savings left so I couldn’t do anything about it.
My story is worse than I’m letting on too, I was extorted for 7-8 months and lost everything. I just don’t know how to prove any of this or move forward with a case and I’m broke now.
And how would I sue without money? I need a lawyer right?
Charge an outrageous pet security deposit. Simple as fuck.
be landlord
haven't raised rent since before covid
tenants have been good hardly call about anything
losing out massively on inflation but no headaches
I'm just going to keep leaving it alone.
When they leave (if ever) I'm going to need a full roof replacement anyway, so I'll just redo the interior and raise rents like 200%, dgaf. I'll try to price out problem tenants.
And if I do sue and even win, it’s not like she’s forced to sell assets to pay me right? I’d have to go to a different court to seek payment, correct? She doesn’t work, so there’s no wages to garnish, and I don’t know that they could force the sale of a home.
All my research has led me to conclude that I just have to deal with it, which is really eating me up.
You can't charge shit for support animals. They aren't even legally defined as pets, they are "tools." Granted, the line is blurred in a lot of states between actual disability animals, and support animals. Some states they are treated exactly the same, some states support animals is just wasting 50 dollars for a useless certificate. Whether it's a support animal or not, you can still sue for damages, but the biggest deposit you can get is 1.5 times rent in many states. If a dog pisses next to the door so bad that it soaks into the concrete, then the landlord is fucked, and the best you can do is sue them for damages beyond the deposit. But some shithead that trys to bypass laws by claiming their stupid mutt is a disability animal probably will be hard to get money out of.
Yeah, you are going to want to consult with a lawyer for sure if you want to pursue this. You don't necessarily need a lawyer if you go through arbitration, but this is a strange enough situation that you may need legal representation. Some lawyers work on contingency, which means you only pay them if you win, they take a portion of your winnings.
If you have an emailed copy of the lease, that will probably be your lifesaver. If it says you have exclusive dwelling rights then it's an easy win. But for lost property, you may be a little fucked.
price out problem tenants
But rentoids are all low status cucks who cant buy a house
You cant the type of people you want to rent because they bought their own home
The problem is I only have a an email with a blank lease attached, with the landlord saying ‘fill it out and I’ll sign’. Here’s the form
eforms.com
The landlord was my mother and we hadn’t had issues before. She had just bought a condo out of state and was moving out. I didn’t see it being remotely possible that she’d be moving back in six months, or that she’d be so unlawful about it. I think she started a late life menopause fueled crisis or something. Obviously dumb in hindsight to not get a robust lease promptly signed.
If I did win though I’d have to go through another court to get payment right? And how would I even get the money out of her when she doesn’t work?
I want to pursue for my mental health mostly at this point. Having my life turned upside down with no justice is driving me insane.
And thank you for taking the time to help.
And how much could I get? I would like to sue for destruction of property, lost income (went out of business and dropped out of college), theft (she was ACH’ing money out of my account somehow) and extortion (threatened to destroy the rest of my belongings and lock me out if I didn’t pay her credit card bills).
I feel like she’s insane enough that she might admit this stuff in court and double down on her behavior or something.
Your property should be all concrete (even internal walls) with a drain in the middle. No matter how hard they chimp out...just gotta run through with a pressure washer when they leave and add an extra coat of toxic paint for the next paypig.
You are probably fucked and may just need to eat the loss. Your case is a bit spotty with the lack of proof, if you did win, you'd probably lose your mom and have to find a new place to rent (either the lease given would be thrown out due to no hard copy, or you'd be out as soon as the lease is up). And like you said, if she is on disability, I'm pretty sure they don't garnish that, the most they could do is go after her assets. If you did successfully sue her, the most the law could do is force her to sell assets over a certain value (they won't make her sell a junker car) but if she has an expensive car, they will probably court order that she lose that. Then they may put a lien on the home, or freeze her bank accounts, but that may just fall back onto you, if she can't pay property taxes and loses the house.
Like I said, this may just be a situation where you eat the loss and try to get something in writing going forward. MAYBE you can gently propose that you want compensation for the lost property, and you don't want thinks to get messy (hint hint) so maybe you can make a deal under the table where you pay no rent or reduced rent for a while. Sounds like she's fucking crazy and you may not get very far though.
How about this? What if i just keep all the light bulbs in my unit and you can charge me 40 dollars per replacement like its stated in the lease? That should be enough to cover it
Sounds like he is the alpha chad and cucked yiu. Cry harder land cuck, bow down to rent chad
I tried to do what your last paragraph described, she essentially thinks she was entitled to do what she did. She actually blames me for a lot of it somehow.
The only nuance to the story I haven’t reveled is that I was an additional member on one of her credit cards. When she destroyed my equipment, the only way I could keep my business moving was now to middle man product rather than produce. This led to bigger bills, which I didn’t think much of initially as the margins were good but stressed her out. I told her I could afford to pay off the balance completely and stop using the card if she provided a lease, but I couldn’t pay and be left with no money and no living security given her erratic behavior, which she took as a threat. She kept pausing and unpausing the card, making me nearly unable to pay as my cash flow was getting obliterated (I would have to pay suppliers with cash, leading me to not having the money for the credit card bill potentially — so when she’d eventually unpause it as she realized I really couldn’t afford it, I’d have to middle even MORE volume and only hope to taper it down over time. It was just absurd and bad for both parties.
She basically kept pulling these levers and refusing to give in, and if I didn’t pay she said she’d throw the rest of my stuff away and lock me out. It was just so illogical and insane. Before she moved back out I was simply unable to pay. So she had to cover a $6k bill. She internalizes this as me stealing from her.
Anyway, yeah the chance for justice seems slim. Sucks.
If they forced the sale of the house, I’d get something out of it finally right?
And hypothetically if I won and could prove everything, how much would I get?
$6k
But again I lost a whole summer of work and was only running up the bill at the threat of extortion. I didn’t make any money and was left penniless. Running up a large bill was the only way I could pay it, and I told her this, and that it would take a couple months to taper down a large bill and it’d only work if the cash flow was perturbed.
I made it clear that this was going to end up in a bad situation where I’d be unable to pay if she kept doing it, but she kept doing it anyway and refused to provide a lease until leaving for some reason.
^*wasn’t perturbed. hope that makes sense. It was really all out of my hands at some point and I ended up not even having an emergency savings. She was forcing my hand and shooting herself in the foot, and now blames me.
