The SEX has not filed its Form C with the Second Circuit yet which will detail what exactly they’re appealing. They need to do that pronto so that Ripple knows how to proceed. Ripple also has 14 days from today to file a cross-appeal if they choose to.

This means that there is a chance that the SEC may only appeal the amount of the fine on Ripple, and not go after the programmatic sales.
Combine that with Ripple continuing to move forward with their stable coin launch, and it adds up to one conclusion:

Someone yelling “fire” in a crowded theatre usually = false alarm.
The fact that David posted this literally the day before, is suspicious.
Granted, he does post a lot of random normie bullshit.
However, he does post hints and clues once in a blue moon.
I think David is telling us in coded language, that this is a false alarm.
The SEC only filed a notice that they will appeal.
They haven't even filed the paperwork for what they want to appeal.
If they decide to only appeal the amount of the fine, and nothing else, then the appeal doesn't matter.
The appeal only negatively effects XRP, if the SEC appeals the programmatic sales portion of the ruling.

I must say that I'm not surprised that this occurred, but it is demoralizing nevertheless. I was really hoping to get at least a mini-moon before the election shit show begins and we go to war with Iran to at least have a better emergency fund but I guess that's not happening. I did watch the vice-presidential debate.
It provided a perfectly reasonable explanation for why Schwartz would make that post.
And at the same time, "All the world is a stage."
Many of Tim Waltz' responses to questions seem very rehearsed during the debate.
Like he knew what the questions would be ahead of time.
Perhaps part of Waltz' job was to bring up the "shouting fire in a crowded theater", so that Schwartz could later use it as an excuse to send a coded message.
And to peel back the onion another layer, maybe there were even fall backs.
Let's say that Tim Waltz hypothetically hadn't made that fire in a crowded theater argument during the debate.
What if some other world event involving that phrase, would then have been activated on that night,
for the sole purpose of providing Schwartz an excuse to say that phrase.
